Purpose

As Somplast Plastik Dış Ticaret ve Sanayi Ltd. Şti. (“Somplast” or the “Company”), we attach great importance to protecting the personal data of our customers, potential customers, employees, job applicants, suppliers, business partners, visitors and other natural persons.

This Personal Data Protection Policy (“Policy”) has been prepared to explain the fundamental principles and practices adopted by Somplast within the scope of the applicable legislation on the protection of personal data, particularly Law No. 6698 on the Protection of Personal Data (“KVKK”).

Somplast aims to process personal data lawfully, securely and transparently while respecting the fundamental rights and freedoms of data subjects.

Scope

This Policy covers personal data processed in relation to:

business partners,

employees,

job applicants,

visitors,

website users,

service providers,

and other natural persons who have any commercial or legal relationship with Somplast.

The Policy sets out Somplast’s general approach to the processing of personal data.

What Is Personal Data?

Personal data means any information relating to an identified or identifiable natural person.

Information that may constitute personal data within the scope of Somplast’s activities may include:

name and surname,

telephone number,

email address,

company and job title information,

communication records,

quotation and request information,

order and sales information,

technical service records,

invoice and financial transaction information,

website usage information,

transaction security information.

The scope of the personal data processed may vary depending on the nature of the relationship established with Somplast and the transaction performed.

Fundamental Principles for Processing Personal Data

Somplast adopts the following fundamental principles when processing personal data:

Personal data is processed in accordance with the law and the principles of fairness.

Accuracy and Being Kept Up to Date Where Necessary

Reasonable measures are taken to ensure that personal data is accurate and kept up to date where necessary.

Personal data is processed for specific, explicit and legitimate purposes.

Being Relevant, Limited and Proportionate to the Purpose of Processing

Personal data is processed only to the extent necessary for the purpose for which it is processed.

Retention for the Necessary Period

Personal data is retained for the period prescribed by applicable legislation or required by the purpose of processing.

Purposes of Processing Personal Data

Depending on the nature of Somplast’s activities, personal data may be processed for the following purposes:

receiving requests for products and services,

preparing quotations and pricing studies,

conducting sales processes,

managing order processes,

providing after-sales services,

providing technical support services,

managing customer and business partner relationships,

conducting contractual processes,

managing delivery and logistics processes,

conducting finance, accounting and invoicing processes,

conducting legal processes,

managing company activities,

ensuring information security,

ensuring the secure and effective operation of the website,

evaluating requests and complaints,

responding to requests from authorised public institutions and organisations,

fulfilling legal obligations.

Legal Grounds for Processing Personal Data

Personal data is processed on the basis of the legal ground applicable to the relevant processing activity from among the conditions stipulated under the KVKK.

Within this scope, personal data may be processed where any of the conditions stipulated under the KVKK apply, such as:

being expressly provided for by law,

being directly related to the establishment or performance of a contract,

being necessary for compliance with a legal obligation,

having been made public by the data subject,

being necessary for the establishment, exercise or protection of a right,

the legitimate interests of the data controller,

the explicit consent of the data subject.

To the extent possible, Somplast does not make data-processing activities that do not require explicit consent conditional upon obtaining such consent.

Where explicit consent is required, the data subject is provided with the necessary information, and consent is obtained for a specific matter, based on adequate information and given freely.

Special Categories of Personal Data

Somplast processes the special categories of personal data listed in Article 6 of the KVKK only where a processing condition stipulated by law and applicable to the specific activity exists and provided that the adequate measures determined by the Personal Data Protection Board are implemented.
Special categories of personal data are not requested or processed unless they are necessary, relevant, limited and proportionate to the purpose of processing. Cases requiring explicit consent are distinguished from the circumstances under Article 6 of the KVKK that permit processing without explicit consent.

Where processing is necessary, the required technical and administrative measures are implemented in accordance with the applicable legislation.

Collection of Personal Data

Personal data may be collected through automated or non-automated means via channels such as:

the Somplast website,

contact and quotation forms,

email,

telephone,

face-to-face meetings,

contracts,

quotation and order documents,

technical service processes,

trade fairs and events,

business partners,

suppliers.

Transfer of Personal Data

Somplast may share personal data with third parties only where permitted by the applicable legislation and provided that such transfers are relevant, limited and proportionate to the purposes of processing.

Within this scope, where necessary, personal data may be transferred to:

authorised public institutions and organisations,

legal and financial advisers,

service providers,

suppliers,

logistics and courier companies,

information technology service providers,

business partners,

manufacturers represented by Somplast or for which Somplast acts as a distributor.

The parties to whom personal data may be transferred and the legal grounds for such transfers are separately explained in the Privacy Notice according to the nature of the relevant data-processing activity.

Where personal data is transferred abroad, the current transfer framework stipulated under Article 9 of the KVKK applies. In the absence of an adequacy decision, regular or systematic transfers abroad are not carried out without one of the appropriate safeguards stipulated by law being provided; occasional transfers are evaluated only where the exceptional conditions specified by law are met. Where a standard contract is used, the notification obligations stipulated by the applicable legislation are fulfilled within the prescribed period.

Security of Personal Data

Pursuant to Article 12 of the KVKK, Somplast implements the necessary technical and administrative measures appropriate to the nature and level of risk of the data processed to prevent the unlawful processing of and access to personal data and to ensure its secure retention.

To prevent personal data from being processed unlawfully,

being accessed unlawfully,

being lost,

being used by unauthorised persons,

Somplast takes care to implement technical and administrative measures appropriate to the nature of the data processed.

Within this scope, Somplast aims to implement the necessary security measures in areas such as information system security, access authorisations, data-security practices and employee awareness.

Somplast aims to improve its security practices in line with technological developments and emerging risks.

Retention of Personal Data

Personal data is retained by taking into account:

the periods prescribed by applicable legislation,

the period required for the purpose of processing,

the period during which legal or commercial obligations remain in effect.

Upon expiry of the retention period or when the purpose of processing ceases to exist, personal data is deleted, destroyed or anonymised in accordance with the applicable legislation.

Explicit Consent

Explicit consent is obtained from the data subject for data-processing activities that require explicit consent under the KVKK.

Explicit consent is obtained:

for a specific matter,

based on adequate information,

freely.

As a rule, withholding explicit consent does not prevent a person from benefiting from services for which explicit consent is not required. However, circumstances in which the relevant data-processing activity is necessary for the provision of the service are evaluated separately.

Commercial Electronic Communications and Marketing Activities

Where Somplast carries out commercial communications concerning products, services, campaigns, announcements and similar matters, the permission, approval and opt-out mechanisms stipulated by the applicable legislation are taken into account.

Where necessary, permissions for sending commercial electronic communications are obtained separately from other permissions relating to the processing of personal data.

The legal requirements for processing personal data for marketing and promotional purposes are evaluated separately.

Cookies

Cookies may be used on the Somplast website to ensure that the website operates securely and effectively, improve the user experience and, where necessary, perform statistical analyses.

Rights of Data Subjects

Under Article 11 of the KVKK, data subjects have the right to:

learn whether their personal data is being processed,

request information if their personal data has been processed,

learn the purpose of processing and whether their personal data is being used in accordance with that purpose,

know the third parties to whom their personal data has been transferred in Türkiye or abroad,

request the correction of personal data that has been processed incompletely or inaccurately,

request the deletion or destruction of personal data within the framework of the conditions stipulated under the KVKK,

request that correction, deletion or destruction procedures be communicated to third parties to whom the personal data has been transferred,

object to an adverse result arising from the analysis of personal data exclusively by automated systems,

request compensation for damages incurred as a result of the unlawful processing of personal data.

Right to Submit an Application

Data subjects may apply to Somplast to exercise their rights under the KVKK.

Applications must be submitted in accordance with the methods and requirements specified in the applicable legislation.

Applications are concluded free of charge as soon as possible according to the nature of the request and, in any event, within the maximum period prescribed by the applicable legislation. If processing the application incurs an additional cost, the fee specified in the tariff determined by the Personal Data Protection Board may apply.

The legal ground applicable to each personal data-processing activity is determined according to the nature of that activity. In particular, quotation and contractual processes may be evaluated under Article 5/2(c) of the KVKK; statutory records, invoicing and obligations arising from legislation under Article 5/2(a) and/or (ç); the establishment, exercise or protection of legal claims under Article 5/2(e); and information security and reasonable business processes under Article 5/2(f), provided that the fundamental rights and freedoms of the data subject are not harmed. Explicit consent is used only for activities where no other processing condition applies and where it is legally required.

In the absence of an adequacy decision, regular or systematic transfers abroad are not carried out unless one of the appropriate safeguards is provided. Where personal data is transferred to overseas manufacturers represented by Somplast or for which Somplast acts as a distributor, the purpose of the transfer, data categories, recipient group and transfer mechanism used are specified for the relevant process.
ARTICLE 7: RETENTION OF PERSONAL DATA
Your personal data is retained for the period required by the purposes of processing, taking into account the retention periods prescribed by applicable legislation.
Upon expiry of the retention period or when the grounds requiring the processing of personal data cease to exist, the personal data is deleted, destroyed or anonymised in accordance with the applicable legislation.
ARTICLE 8: SECURITY OF PERSONAL DATA
Somplast takes care to implement technical and administrative measures appropriate to the nature of the data processed to prevent the unlawful processing of and access to personal data and to ensure its secure retention.

Under Article 11 of the KVKK, data subjects have the right to:
